MLS”) respects your privacy and
uses its best efforts to protect the privacy of our members and visitors to
this web site. The following Internet Privacy Policy (the “Policy”) contains
general and technical details about how BAREIS
MLS treats data collected and
received from you as a member of BAREIS
MLS.
Types of Information We Collect
BAREIS MLS gathers personal data from you which is required to be a member.The information includes but is not limited to your
name, address, email address, phone number, fax number, and real estate license
data when you voluntarily subscribe or register for BAREIS MLS services.
BAREIS
MLS collects personal financial data, which may include
but is not limited to your credit card number or bank account number, if you
voluntarily choose to pay BAREIS
MLS invoices for services
through our automated billing services.
Through use of the BAREIS MLS prospecting system BAREIS
MLS also gathers the personal
data, which includes but is not limited to the name, address, email address and
phone number of prospects and customers of your services, when you voluntarily
submit such information through the listing or prospect functions of the
system.
The email you send through
the MLS system hosted by Rapattoni is housed for 30 days.
BAREIS
MLS collects property listing data, which includes but
is not limited to images, if you submit property listing data to BAREIS MLS.
Sharing of Personal Data, Financial
Data, and Property Listing Data
BAREIS MLS will NOT share, sell, or otherwise transfer your personal data
or the personal data of prospects or other indirect recipients of BAREIS MLS services to any other third persons or entities in ways
different from what is discussed in this Privacy Statement.
BAREIS
MLS approved vendors that produce the MLS system,
productivity tools, member internet sites, public internet sites, and products
that are compatible with, compliment, and/or enhance MLS services will have
access to your name, address, phone, email and listing data of BAREIS MLS members. Approved vendors are prohibited from using the data
for any other purpose than to facilitate the operation of their product or service
provided to our members. Vendors are prohibited from selling, reproducing, or
transmitting any data obtained or that comes into their possession as a result
of their role as a vendor to any other party.
Members of BAREIS MLS will
have access to your contact information including your address, phone numbers,
and email address, for the purpose of transacting business.Members
are prohibited by the Rules and Regulations of the Service from selling,
reproducing, or transmitting any data obtained or that comes into their
possession as a result of their role as a member to any other party except for
the purpose of selling or appraising property.
Statistical analysis and
aggregation of the property listing data may be made available to the media and
other interested parties for public representation. This statistical information
will not disclose the details of individual transactions or contain the
characteristics of individual properties, their owners, or the agent(s) selling
the property.
BAREIS
MLS may disclose, transfer, sell or assign information
within the Rules and Regulations of the Service, although it is not the current
policy of BAREIS MLS to do so.In addition, BAREIS MLS may disclose, transfer, sell or assign property information and/or
your personal data, or the personal data of prospects or other indirect
recipients of BAREIS MLS services to third parties as a
result of a sale, merger, consolidation, change in control, transfer of
substantial assets, reorganization or liquidation of BAREIS MLS.
BAREIS MLS does not access your prospect information or email without your
specific permission to do so.
BAREIS
MLS reserves the right to use or disclose any
information as needed to satisfy any law, regulation or legal request, and/or
to cooperate in any law enforcement investigation or an investigation on a
matter of public safety.
Proprietary Rights
The Rules and Regulations of the service, under which every member has access
and use of the property listing information and BAREIS MLS
services, state that when you submit property listing data to BAREIS MLS including but not limited to images, that data becomes part of
the BAREIS MLS listing database compilation. All
rights, title, and interest in each copy of every BAREIS MLS
compilation and image created and copyrighted by BAREIS MLS remains
at all times vested in BAREIS MLS. Copyright and ownership interest
in images submitted by BAREIS MLS members for inclusion in the
database remain with the BAREIS MLS Participant on whose behalf the
image was submitted. However, the BAREIS
MLS Participant licenses BAREIS MLS to reproduce, distribute and transform such images and place a
BAREIS MLS copyright legend on each such image by virtue of posting the
image to the compilation. Ownership of BAREIS
MLS database compilation and
each BAREIS MLS member’s "use" is
governed by the BAREIS MLS By-Laws and Rules and Regulations.
Cookies
”Cookies” are small data files stored on your computer’s hard drive containing
information about you and your computer. Some BAREIS MLS web
services may set and access cookies during the use of those web services in
order to provide a more customized user experience. You may disallow receiving
cookies at any time through your web browser, however
it may affect your ability to access BAREIS
MLS web services.
Jurisdiction
The BAREIS
MLS web site is operated form
our facilities in the United States of America .We make no representation and
take no responsibility for any applicable laws and regulations outside the
United States .Members who may choose to access BAREIS MLS from the
European Union or elsewhere other than the United States do so at their own
discretion and initiative and are responsible for compliance with local laws.
